This morning, the Illinois Supreme Court found that the Pre-Trial Fairness Act can take effect and it will lift it's stay on September 18. In 60 days, Illinois will have no cash bond. The Act is unclear in some areas and contradictory in others, so local courts will be making this up as they go. It means most criminal defendants will be released before trial. Those who are held will be held without possibility of bond. I'll try to post about it as we figure it out. #LawFedi #CrimLaw #BailReform

It was to take effect on January 1 but was stayed by the Illinois Supreme Court pending decision on various cases. We are expecting the decision this morning on whether it becomes effective and in what form. There are so many possible outcomes that I almost wish I had set up a betting pool. Assuming we get bond reform, I'll try to toot about it

The response was a well-crafted Motion to Suppress Evidence but the grounds were boilerplate (without consent, no PC, fruit of the poisonous tree, the latter not being supported by the alleged facts in the motion). No mention of the unlawfully prolonged stop.

2.1.2023 21:51Montmorency Falls, QuébecThe Illinois legislature, this year passed the Pre-trial Fairness Act, which, effective January 1, eliminates cash bond. The Act is complicated and several sections do not seem to have much thought put into them and many attorneys have spent many hours figuring out how to implement it. I have drafted Motions for each of my clients in jail ready to file Tuesday morning.
Yesterday, the Illinois Supreme Court stayed the effective date pending ruling on the legality of the Act.
